Terms and Conditions (T&C)
1. Scope
These Terms and Conditions apply to all orders placed through our online shop at [www.fauna-design.com]. The seller is Judit Schwalb, based at Arsenalstraße 16/1203, 1100 Vienna, Austria.
2. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the order button, you place a binding order for the goods in your shopping cart. You will receive confirmation of receipt of your order by email immediately after submitting your order. The purchase contract is only concluded when we send a separate order confirmation or at the latest when the goods are delivered.
3. Prices and Shipping Costs
All prices are displayed in the local currency of the respective EU country and include the applicable VAT. Additional shipping costs may apply, which are clearly indicated during the checkout process. For deliveries outside the EU (e.g. to Switzerland or the UK), additional customs duties and import taxes may apply, which are the responsibility of the customer.
4. Delivery
Our products are made in small batches or to order. The delivery time is usually 1–3 weeks. For custom-made items, delivery time may be longer. We reserve the right to withdraw from the contract if the promised service is unavailable. In such cases, we will notify you immediately and refund any payments made without delay.
5. Payment
Payment is made using the payment methods offered in the shop (e.g. credit card, PayPal, etc.). We reserve the right to exclude certain payment methods.
6. Right of Withdrawal / Returns
You have the right to return standard items within 30 days without giving a reason. The return period begins upon receipt of the goods. Timely dispatch of the withdrawal or the goods is sufficient to meet the deadline.

In the event of a valid withdrawal, all mutually received benefits must be returned. We will cover the cost of return shipping. Refunds will be made via the same payment method used for the original order, unless otherwise agreed.
Important notice for custom-made items:
Products that have been made to your specifications or clearly tailored to your individual needs are excluded from the right of return, as they cannot be resold. By ordering a custom-made item, you expressly agree that it is excluded from the right of withdrawal.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Warranty
Statutory warranty rights apply. Please report any defects immediately, but no later than 14 days after receipt. The warranty period is 24 months. In case of a justified defect, you are entitled to repair or replacement. If this fails, you may request a price reduction or withdraw from the contract.
9. Liability
We accept unlimited liability for intent and gross negligence. In the case of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal duties) and limited to the foreseeable, contract-typical damages. These limitations do not apply to damages resulting from injury to life, body or health, for defects covered by a guarantee, or in cases of fraudulent concealment of defects.

The processing of your data takes place in accordance with our privacy policy, which can be viewed at [link to your privacy policy].
11. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/. We are not obliged and do not participate in dispute resolution procedures before a consumer arbitration board.
12. Applicable Law and Jurisdiction
Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection provided by mandatory laws of the country in which they have their habitual residence. The place of jurisdiction, where legally permissible, is Vienna.
13. Severability Clause
Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the relevant statutory provision.
