Terms and Conditions (T&C)

Scope
These Terms and Conditions apply to all orders placed through our online shop at www.fauna-design.com. The provider is Schwalb Judit, Arsenalstraße 16/1203, 1100 Vienna, Austria.

Offer and Contract Conclusion
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalog. By clicking the order button, you submit a binding order for the items in your shopping cart. Confirmation of receipt of your order will be sent immediately via e-mail. The purchase contract is concluded only with our separate order confirmation or at the latest upon delivery of the goods.

Prices and Shipping Costs
All prices are shown in the respective local currencies of the EU countries we sell to. According to § 6 para 1 Z 27 UStG (Austrian Small Business Regulation), our invoices do not include VAT. Shipping costs are shown separately during the ordering process. For deliveries outside the EU (e.g., Switzerland or the UK), additional customs duties and import taxes may apply, which must be borne by you.

Delivery
Our garments are made in small batches or made to order. Delivery usually takes 1–3 weeks, depending on whether the item is in stock or produced specifically for you. For custom-made orders, delivery times may be longer. If a product is unavailable, we reserve the right to withdraw from the contract. In such cases, you will be informed promptly, and any payments already made will be refunded immediately.

Payment
Payment is made by invoice. You will receive the invoice via email once your order has been shipped. The invoice amount must be transferred within 7 days of receiving the invoice, unless otherwise agreed. Payment details and bank information will be provided in the invoice. We reserve the right to request advance payment for specific orders.

Right of Withdrawal / Returns
You have the right to return standard products within 30 days without giving any reason. The withdrawal period begins upon receipt of the goods. It is sufficient to send the withdrawal notice or return the goods within this period.

In the event of a valid withdrawal, payments received will be refunded. We cover return shipping costs. The refund will be issued via the same payment method unless otherwise agreed.

Important Notice for Custom-Made Products
Products that are individually made to your specifications are excluded from the right of withdrawal. By ordering a custom-made garment, you explicitly agree to this exclusion.

Retention of Title
The goods remain our property until full payment has been received.

Warranty
The statutory warranty rights apply. Please report visible defects within 14 days of receiving the goods. The warranty period is 24 months. In case of justified defects, you have the right to a remedy (repair or replacement). If the remedy fails, you may reduce the purchase price or withdraw from the contract.

Liability
We accept unlimited liability for intent and gross negligence. For slight negligence, we are liable only for breaches of essential contractual obligations (cardinal obligations) and limited to foreseeable damages. Liability for damage to life, body, or health remains unaffected.

Online Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/. We do not participate in dispute resolution proceedings before a consumer arbitration board.

Applicable Law and Jurisdiction
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence. The place of jurisdiction, insofar as legally permissible, is Vienna.

Severability Clause
Should any provision of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory regulation.
